THE DEPOSIT AND RECYCLE ACT

 

An act promoting & relating to the recycle and the return, and deposit upon and disposal of manufactured or created items sold in the United States.

BE IT ENACTED BY THE LEGISLATURE OF THE UNITED STATES:

SECTION 1.

[a] The DEPOSIT & RECYCLE COMMISSION is established which duty it shall be to oversea and guide and implement this ACT.

[b] The COMMISSION shall establish the EDUCATIONAL ACCOUNT with the .50% of any deposit collected from anyone other than the buyer.

SECTION 2.

[a ] There shall be a .10 cent deposit placed on any item sold covered by this act.

[b] The .10 cent deposit shall include :

[a] a .05 cent deposit from the buyer

[b] a .05 cent deposit from the manufacturer or creator of the item.

[c] the word �DEPOSIT� shall be clearly marked in #16 print on the item.

[c] Any vendor who publicly sells the item or the same-as the �deposited item � is required to receive and return to the manufacturer that item and to return the dollar amount in cash to the individual who presents the for �return on deposit�.

[d] The vendor shall hold in a separate account the amount of the deposit money that represents the Manufactures or creators portion of the money.

SECTION 3.

[a] These items shall require a �deposit� under this act:

ORGANICS. All magazines, cigarette pack or box, containers, boxes, or

structures or constructions that enclose any item or in which good are sold from any vendor to any buyer or transported to any vendor. and or from any vendor to any customer. Also any cigarette packs or box.

PLASTICS. Any and all containers or wrappers made of plastic, Polystyrene, Foam, or combinations containing plastics in which products are sealed and or sold from vendor to any customer shall require a .10 cent deposit. Also any plastic container able to hold carry water or liquids.

METALS . All cans containing product and sealed shall have a .10 cent deposit upon them. This includes aluminum, steel and bi metal cans.

GLASS. All glass containers which have been sealed and sold or carry product or are transferred for consideration of any type shall carry a .10 cent deposit. Color of glass is insignificant to this act.

OTHER WASTE. Each led-acid battery and each tire that is on or is a wheel shall require a $10.00 deposit and split 50/50 by the manufacturer and buyer.

SECTION 4.

[a] This ACT takes effect and is in force 30 days after its passage.

[b] Effective 30 days after the passage of this ACT, the comptroller of public accounts shall create a new FUND and title it THE EDUCATIONS FUND.

This fund shall consist of all moneys remaining from the collection and reclaiming of �deposits�. Money from this fund shall be equally divided % per student toward the education of TEXAS children provided that a 2 hour work-out P.E. program be adopted in each school grades 1-12 and a new athletic diet be installed in each cafeteria.

SECTION 5. The importance of this legislation and the crowed condition of the calendars in both houses create an emergency and an imperative public necessity that the Constitutional Rule requiring bills be read on three several days in each house be suspended, and this rule is hereby suspended, and that this ACT take effect and be in force according to its terms and it is so enacted.
